What to expect from this webinar?

  •  Brief summary / explanation of the various legal tests for distinguishing between employees, workers and self-employed persons. Reference to s.230 ERA 1996, s.41 & 83 Equality Act 2010, s.54 MWA 1998, regulation 2 WTR 1998 and the IR35 tax regime.
  • Practical examples. Reference to HMRC guideline examples and recent case law including Pimlico Plumbers Ltd v Smith [2017] EWCA Civ 51; Capita Translation & Interpreting Ltd v Siacuinas and the Ministry of Justice (EAT, 23 February 2017), Windle v Secretary of State for Justice [2016] EWCA Civ 459 and RS Dhillon v HMRC [2017] UKFTT 017 (TC).
  • Summary of the significance of the distinctions from the point of view of employment rights, discrimination and (basic) tax law.

We are reviewing the recent tribunal cases involving Uber etc. and because it is an issue HR need to be aware of. We recently had to advise various local authorities on the significance of the distinction from a practical point of view and have been involved in arguing both sides of the coin in the tribunal this year.
